A man violated labor discipline. In his position as an employee of the CNAP department, he failed to fulfill his duties related to the issuance of archival certificates. This is stated in the ruling of the Lipovodolinsky District Court of the Sumy region, published on March 27, 2024.
By the order of the chairman of the Synovskyi village council dated February 5, 2024, No. 14-K, the employee of the CNAP department of the Synovskyi village council was reprimanded for his violation of labor discipline committed on February 5, 2024, which involved refusing to perform job duties related to the issuance of archival certificates. By the order of the chairman of the Synovskyi village council dated February 5, 2024, No. 15-K, the employee of the CNAP department was dismissed from his position under paragraph 3 of Article 40 of the Labor Code of Ukraine due to systematic failure to perform work duties without valid reasons. The basis for the dismissal was indicated as the reprimand orders dated January 10, 2024, and February 5, 2024.
Thus, for the same violation of labor discipline, the employee of the CNAP department of the Synovskyi village council faced disciplinary action twice from the village head, which constitutes a violation of labor legislation requirements, particularly part 2 of Article 149 of the Labor Code of Ukraine. During the court session, the defendant acknowledged his guilt.
The court decided to hold the man administratively liable for committing an administrative offense under part 1 of Article 41 of the Code of Ukraine on Administrative Offenses. He was fined thirty thousand rubles, equivalent to 510 hryvnias.
