A woman was caught illegally selling fuel vouchers for OKKO, WOG, and other networks at the market. Here's the court's decision on the matter.

A woman at the market was selling fuel vouchers from networks such as OKKO, WOG, and Shell. She was found guilty of committing an administrative offense and fined. This information is stated in the ruling of the Ternopil City District Court of Ternopil Region, published on January 24, 2022.

On November 17, 2021, while on the territory of the central market in Ternopil, the woman was engaged in the sale of fuel vouchers (from networks such as WOG, OKKO, Aviass, and others), which require separate licensing. She committed an administrative offense as outlined in part 1 of Article 164 of the Code of Ukraine on Administrative Offenses. During the court session, the citizen acknowledged her guilt in committing the administrative violation and requested that she not be punished severely and that confiscation of the seized items not be applied.

According to a statement dated November 18, 2021, a man requested that unknown individuals be held accountable for fraudulently selling foreign currency and fuel vouchers at the bus station on November 17, 2021. From the attached protocol of the victim's interrogation dated November 18, 2021, within the framework of the criminal proceedings initiated on November 17, 2021, it is evident that he was at the bus station in Ternopil on November 17, 2021, and noticed an advertisement banner indicating currency exchange and fuel voucher sales. He purchased currency totaling 100 dollars from an unknown woman but suspected the banknote was counterfeit. He also noted that the prices of the fuel vouchers being sold at the exchange booth differed from the average market price at gas stations, prompting him to report the fraudulent activities to the police.

Additionally, as noted in a statement dated November 23, 2021, the woman received from police officers a sum of 84,235 hryvnias and the fuel vouchers in the same quantity as those seized, along with 19 signs and 3 notebooks.

What punishment did the court impose?

The court found the woman guilty of committing an administrative offense as outlined in part 1 of Article 164 of the Code of Ukraine on Administrative Offenses. She was imposed an administrative penalty in the form of a fine to the state amounting to one thousand non-taxable minimum incomes of citizens, which totals 17,000 hryvnias to the state, along with the confiscation of the products and money seized during the inspection of the crime scene on November 17, 2021.

"The actions of the citizen exhibit signs of an administrative offense as outlined in part 1 of Article 164 of the Code of Ukraine on Administrative Offenses for conducting business activities without state registration as a business entity and without obtaining a license for the type of business activity subject to licensing under the law, therefore she should be held administratively accountable," the court emphasized.
