The woman did not register her place of residence within three months from the date of state registration, specifically since August 20, 2007. Employees of the CNAP decided to hold her administratively accountable. This is stated in the ruling of the Kyiv-Sviatoshyn District Court of the Kyiv region, published on September 2, 2024.
The woman violated the requirements of Article 6 of the Law of Ukraine "On Freedom of Movement and Free Choice of Place of Residence in Ukraine." She failed to register her place of residence within three months from the date of state registration, specifically since August 20, 2007. The Department of Administrative Services of the Borchahevskyi Village Council of Bucha District in the Kyiv region decided to hold her administratively accountable.
The woman did not appear at the court hearing, despite being duly informed of the date, time, and location of the proceedings.
The court found the woman guilty of committing an administrative offense as stipulated in Part 1 of Article 197 of the Code of Ukraine on Administrative Offenses (KUAO). A warning was issued as a measure of influence.
“According to Part 1 of Article 197 of the KUAO, the residence of citizens who are required to have a passport of a citizen of Ukraine without such a passport or with an invalid passport, as well as the residence of citizens without registration of a place of residence, results in a warning. The woman’s guilt in committing the administrative offense under Part 1 of Article 197 of the KUAO is confirmed by the administrative offense protocol series AA No. 004307 dated July 4, 2024, and the materials of the administrative offense case. The court deems it necessary to apply a measure of influence in the form of a warning based on Article 24-1 of the KUAO, which will fully ensure the prevention of further offenses,” the court noted.
